PURPOSE AND SCOPE OF THIS POLICY

This website (“Site”) and the services provided here, including access to the services therein (collectively, “Services”) are operated by  Never Give Up LLC (“Never Give Up” or “We”).  This Privacy Policy (“Policy”) sets forth Never Give Up’s policies regarding the collection, use and disclosure of information that you, the individual person accessing this Site, provide to us or that we otherwise collect, while you are using the Site or the Services.

WHAT INFORMATION IS COLLECTED

We may collect information that you provide directly, such as during our registration process, as well as information that we collect through your use of the Site or Services.  In this Policy, we sometimes refer to information that we collect from our about you as “Your Information.”  We do not collect personally-identifiable information from children under the age of 13.

Except as set forth in this policy, we will not use or disclose personally-identifiable information that we collect from or about you while you are using the Site or Services.

The term “personally-identifiable” information means information that is identified with you as a specific individual, such as your name and address.

If you are located outside of the United States while accessing the Site, please be advised that your information will be transmitted into the United States and other countries.  You consent to this transfer and represent to us that you have the right to disseminate your information outside of the country where you are located. 

Information You Provide

Users to the Site may provide information to us directly, such as through:

• Forms filled out by the user
• Correspondence
• Surveys
• User Submitted Content posted to the site
• Chat logs, forum posts and questions
• Requests for Services

For example, as a condition to accessing some Services, we may ask you to complete an online registration form.  A registration form may ask for information both about the individuals who access the Site as well as any company or other organization with they are employed or otherwise affiliated.   As part of this registration process, you may be provided with credentials including a user identification and password. This information is collected to confirm eligibility for use of the online services, to establish the identity of authorized users, and for business contact purposes.

You may also elect to post information on publicly-accessible parts of the Site, including your profile and forum posts.  We do not treat such posts, even if including personally-identifiable information, as private information subject to our privacy policies.  Do not post information on public parts of the Site that you do not intend to share freely with the world at large.  The Services may also permit you to communicate with other users of the Site such as through messages that are not publicly accessible.  We are not responsible for protecting information that you choose to share with other users insofar as those other users may use or further disseminate that information.

Technological Information

In addition to information you provide, we may use software and other technology to collect information about your use of the Site such as the Services that you use, the IP address from where you access the Site, and other information about your computer and Internet connection, such as the type of browser or operating system that you use.  We may also collect aggregate data about use of the Site from you and other users, such as the total number of visitors to our site, the number of visitors to each page of our site, the domain names of our visitors’ Internet service providers, and other type of technical information.

We may use embedded pixel technologies and other technologies to help track site usage and marketing campaign responsiveness. On the Web site, these technologies are used on selected pages for the purposes of identifying unique user visits as opposed to aggregate hits.

Never Give Up may also use cookies on all or some portions of the Site.  A cookie is an identifier that is sent to your browser from a web server and stored on your computer.  Cookies enable us to provide you with a better experience by allowing us to understand what areas of the Web site are of interest to our visitors. Never Give Up may also use cookies when you register to use one of our web-based services.  In this situation, a cookie will store useful information that enables our Web site to remember you or your preferences when you return to visit us. While we don’t offer an opt-out on the site for cookies, browsers provide you with information and control over cookies. You can set your Web browser to alert you when a cookie is being used or to refuse cookies.  If you refuse to accept cookies, you may not be able to access some portions of the Site our use all of the Services.

HOW WE USE INFORMATION

We may use the information that we collect from and about you to operate, maintain and improve upon the Site and the Services, including to:

• Resolve technical problems
• Present the Site in effective manner for you and your computer
• Improve the Site or Services
• Provide requested information, services, or products
• Notify you about changes to Site, Services or the terms and conditions of use (including this Policy)
• Track usage patterns of the Site or Services

We may use your information, or permit others to use your information, to contact you about goods and services that may be of interest to you when you have consented to such contact.  If you do not want us to use your information in this, you may tell us by selecting or deselecting appropriate option presented to you when we collect your information.

We may aggregate your information with usage information collected from other uses to provide statistics, trend information and other data that is not personally-identifiable, and we may provide that information to third parties.

Never Give Up may use your information for its own marketing purposes. This may include providing you with information targeted to your interests. We will give you the opportunity to elect not to receive direct-marketing materials from us.  We will also use your information to select (or assist third party advertisers in selecting) advertisements that may be displayed to you when you use the Site or Services.

We may acquire information about you from third party sources and combine that information with the information that we collect.  The information that we acquire from third party sources is not subject to this Policy.

If you elect to send us a communication with feedback regarding the Site or Services, including information to improve, supplement, correct, or expand the Site or any content or services through the Site, we may keep a record of that communication and we may publish your communication (not including your personally-identifiable information)  to others your posting or correspondence and we may post that information  or use it to improve the Site or Service.

Never Give Up will not sell any personally-identifiable information that you provide, except that we may transfer information that we collect from our about you to our corporate affiliates (that is, our corporate subsidiaries, parents and other affiliates) or to companies that acquire Never Give Up or its successors, or in connection with a bankruptcy, receivership or liquidation of Never Give Up, provided that in all these cases the information will continue to be subject to the terms of this Policy in the hands of a new owner.

We may disclose information that we collect from or about you to our employees, agents and suppliers who support the operation of the Site and Services solely to permit those employees, agents suppliers to provide their services to us.    If we discover that an employee, agent or supplier is using or disclosing this information for other purposes, we will take reasonable actions to stop such use or disclosure.

We may disclose information that we collect from or about you if necessary to comply with legal requirements, including subpoenas or court orders compelling us to disclose the information or upon the request of law enforcement authorities when we believe, in our judgment, that such disclosure is helpful to protect you, us or the public at large.  We may also use or disclose information that we collect from our about you to enforce intellectual property rights or enforce terms of service or other contracts between you and Never Give Up.

DATA SECURITY

Never Give Up uses reasonable efforts to safeguard the confidentiality of your personally-identifiable information. Unfortunately, it is impossible to guarantee the security of data transmission over the Internet or any wireless network. Therefore, although we take reasonable measures to protect your information, Never Give Up cannot ensure the security of any information you transmit to us or from online services and you do so at your own risk. Once we receive your transmission, we will use reasonable efforts to ensure its security on our systems.

Never Give Up provide links to third-party sites, which we do not control.  We are not responsible for information that you provide to those third-party sites.  We recommend that you review the privacy policies if any provided at those sites.

DATA INTEGRITY

To ensure that the personal information that you provide to us is accurate, we will provide you with reasonable access to that personal information as well as the opportunity to update that information.  We will do this either upon written request by you to us at the contact address below or by providing you with a readily available facility to access and edit that information online (such as through your account profile).   Note that after your information is edited, older versions of that information (including outdated or inaccurate versions) may remain on our systems including our backup and archive files.

CHANGES TO THIS PRIVACY POLICY 

We may change or add to this Policy, and such updates will be posted on this page.  We will not reduce your rights under this Policy with regard to information that we have already collected without your explicit consent.  We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice.  Upon written request to us at the contact address provided below, we will provide you with copies of prior versions of this Policy.
